Advertiser / Brand Terms
These Advertiser / Brand Terms (“Advertiser Terms”) govern your access to and use of the Viewr platform (“Viewr”, “we”, “us”, or “our”) as an advertiser or brand (“Advertiser”, “you”, or “your”). By accessing, creating, funding, or launching campaigns on Viewr, you agree to be bound by these Advertiser Terms and the general Terms of Service.
If you are using the Platform on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Advertiser Terms.
1. Role of the Platform
Viewr provides a technology platform that enables advertisers to make campaigns available to independent creators. Viewr acts solely as an intermediary and service provider and does not act as an agent, partner, broker, or representative of any Advertiser or Creator.
Viewr does not guarantee campaign performance, creator participation, or any specific marketing outcome. All creators participating in campaigns do so independently and are not controlled by Viewr.
2. Advertiser Eligibility & Authority
Advertisers must be legally permitted to advertise their products or services and must provide accurate and complete account information. You represent that you have all necessary rights, approvals, and authority to create and fund campaigns on the Platform.
3. Campaign Submission & Approval
All campaigns submitted through Viewr must comply with applicable laws, advertising regulations, and Platform guidelines. Submission of a campaign does not guarantee approval or availability.
Viewr reserves the right to review, approve, reject, pause, modify, or remove any campaign at its sole discretion, including campaigns that may pose legal, reputational, or operational risks.
4. Compliance With Laws & Disclosures
Advertisers are solely responsible for ensuring that their campaigns comply with all applicable advertising, consumer protection, and disclosure laws, including any requirements related to sponsored content, endorsements, or promotional claims.
Advertisers are also responsible for ensuring that campaigns comply with the rules and policies of third-party platforms where content may be published.
5. Intellectual Property & Campaign Materials
Advertisers represent and warrant that they own or have obtained all necessary rights to use any logos, trademarks, music, visuals, or other materials provided in connection with a campaign.
By submitting campaign materials, you grant Viewr a limited, non-exclusive, worldwide, royalty-free license to display, distribute, and use such materials solely for the purpose of operating, promoting, and administering the Platform and campaigns.
6. Creator Content & Responsibility
Creators participating in campaigns act independently and may create content in their own style and expression. Advertisers acknowledge that Viewr does not pre-approve creator content and is not responsible for creator opinions, statements, or conduct.
7. Fees, Budget & Payments
Advertisers agree to pay Viewr the applicable fees associated with each campaign as communicated through the Platform or otherwise in writing. Fees are assessed on a per-campaign basis and are payable directly to Viewr.
Viewr retains discretion over internal allocation of campaign budgets, including platform service fees and creator-related compensation. Advertisers acknowledge that Viewr determines budget distribution as part of providing the Services.
8. Refunds & Cancellations
Except where required by law or explicitly agreed in writing, campaign fees are non-refundable once a campaign has launched or creator participation has begun. Dissatisfaction with campaign performance does not constitute grounds for a refund.
9. Suspension & Termination
Viewr may suspend or terminate advertiser accounts or campaigns at any time, with or without notice, including for violations of these Advertiser Terms, non-payment, or risk to the Platform or its users.
10. Confidentiality
Each party agrees to treat non-public information received in connection with the Platform as confidential, except where disclosure is required by law or necessary to provide the Services.
11. Disclaimers
The Platform is provided on an “as is” and “as available” basis. Viewr makes no warranties regarding campaign performance, creator activity, or uninterrupted access to the Platform.
12. Limitation of Liability
To the maximum extent permitted by law, Viewr shall not be liable for indirect, incidental, consequential, or lost profit damages arising from or related to campaigns or use of the Platform.
13. Indemnification
Advertisers agree to indemnify and hold harmless Viewr from any claims, losses, damages, or expenses arising from campaign materials, advertising claims, legal violations, or misuse of the Platform.
14. Governing Law
These Advertiser Terms are governed by the laws applicable to the Platform, without regard to conflict of law principles.
15. Changes to Advertiser Terms
Viewr may update these Advertiser Terms at any time. Continued use of the Platform following updates constitutes acceptance of the revised terms.
